The project involved the design and construction of a new sewage treatment facility with a hydraulic capacity of 140ML/day.

A major design change was initiated by the owner halfway through the project which had a direct impact to the critical path. Whilst the owner had no problem paying the direct cost for the directed design change there was a dispute in awarding an extension of time and paying the indirect cost.

 
 

Accura Consulting was engaged to establish the cause and effect of the design change. We did this by forensically assessing the evidence and putting together a timeline of events that led up to the change which demonstrated that the Contractor was not in a position to mitigate the delay and was also performing as per the baseline schedule.

This approach allowed for a complex problem to be simplified and an easy-to-understand claim which included a delay analysis, contractual entitlement and a detailed quantum analysis.

Both parties agreed on a full extension of time with costs awarded.
