At the start of 2020, Australia’s vital government transport infrastructure construction projects were in full flow. As cities continued to sprawl and road traffic increased, tunnels provided a critical way of linking different parts of cities without impacting residential areas.

A combination of latent conditions and force majeure events (COVID-19) meant the project suffered several significant delays resulting in the contractor raising a claim against the employer.

Working for the employer, Accura Consulting forensically reviewed the contract, scope and specification and provided a robust contractual and factually based claim. This was in contrast to the global approach taken by the claimant.

Accura Consulting also correctly valued the costs claimed which provided a powerful persuasive case and encouraged a settlement of some claim heads. A cause-and-effect windows analysis was undertaken which demonstrated the true effect of the claimed delays.

Due to the project being extended by five (5) years, Accura Consulting compiled historical and forecast data to determine the probable cost of escalation for the major elements of the project. We were then able to apply a specific uplift or indices to cost types which allowed for a more accurate analysis.

Accura Consulting established the facts in a succinct and persuasive manner, resulting in the claims being settled without the need for formal proceedings.
